1. GENERAL OVERVIEW
The MY CASA CONCEPT online store is operated by MY CASA CONCEPT SRL.
Through our online store, we offer textile products, sheer curtains, drapes, roman shades, blinds, home furnishing products, and other items available for sale in the store.
The technical infrastructure of the online store is provided by Shopify.
By accessing the store or placing an order, you confirm that you have read and agree to these Terms and Conditions, together with the policies published in the store.
Nothing in these Terms and Conditions limits or excludes any mandatory rights granted to consumers under Romanian law or applicable European Union law.

3. PRODUCTS
We make reasonable efforts to present our products as accurately as possible, including their descriptions, dimensions, materials, colors, and images.
Colors displayed on a screen may vary slightly depending on the device, display settings, and lighting conditions.
For textile products, minor differences in shade, texture, or appearance may occur between different production batches, within the normal characteristics of this type of product.
Such variations do not affect the consumer’s statutory rights in the event of a lack of conformity.
4. CUSTOMIZED PRODUCTS
Certain products may be made, cut, tailored, sewn, or adapted according to the customer’s individual measurements and requirements.
The customer must carefully check all measurements, colors, materials, and specifications before confirming the order.
Where measurements are provided by the customer, the customer is responsible for their accuracy.
Where measurements are taken by MY CASA CONCEPT SRL or by persons designated by us, responsibility for those measurements rests with us in accordance with applicable law.
Products made to the consumer’s specifications or clearly personalized may be exempt from the 14-day right of withdrawal.
This exception does not affect the consumer’s statutory rights in relation to defective or non-conforming products.
5. ORDERS
By placing an order, the customer requests to purchase the selected products.
An automatic order confirmation may be sent after the order is placed.
We reserve the right to request additional information where necessary to verify or fulfill the order.
An order may be refused or cancelled, to the extent permitted by law, in circumstances including:
- product unavailability;
- an obvious pricing error;
- inability to process payment;
- reasonable suspicion of fraud;
- incorrect delivery information;
- objective impossibility of fulfilling the order.
If an order that has already been paid for is cancelled by us, any amounts due to the customer will be refunded.
6. PRICES
The applicable price is the price displayed in the store at the time the order is placed, except in the case of obvious errors.
Prices displayed to consumers include applicable taxes, including VAT where VAT is due.
Any additional applicable charges will be presented to the customer before the order is completed.
7. PAYMENT
The available payment methods are displayed during checkout.
The customer must be authorized to use the selected payment method.
Payments may be processed by specialized third-party payment service providers.
8. DELIVERY
Products will be delivered to the address provided by the customer or by the delivery method selected when the order is placed.
Any delivery times communicated are estimates unless a binding delivery deadline has been expressly agreed.
Customized products may require an additional production period.

9. TRANSFER OF RISK
For contracts concluded with consumers, the risk of loss of or damage to the product passes to the consumer when the consumer or a third party designated by the consumer, other than the carrier, takes physical possession of the product, in accordance with applicable law.
10. RETURNS
Consumers have a legal 14-day right of withdrawal for eligible products.
Products made to the consumer’s specifications or clearly personalized may be exempt from this right.

11. LEGAL GUARANTEE OF CONFORMITY
Products sold to consumers benefit from the statutory guarantee of conformity provided by applicable law.
For new goods, the seller is liable to the consumer for any lack of conformity identified within two years from delivery, in accordance with applicable law.
In the event of a lack of conformity, the consumer is entitled to the remedies provided by applicable law.
12. INTELLECTUAL PROPERTY
The texts, images, photographs, graphics, design elements, and other materials available in the store are protected by applicable intellectual property laws, insofar as they belong to MY CASA CONCEPT SRL or are lawfully used by us.
Unauthorized copying, reproduction, distribution, or commercial use is prohibited.
13. PROHIBITED USES
The store may not be used:
- for unlawful activities;
- for fraudulent purposes;
- to transmit viruses or harmful code;
- to infringe the rights of others;
- for unauthorized collection of data;
- to interfere with or compromise the security of the store.
14. LINKS AND THIRD-PARTY SERVICES
The store may use third-party services, including payment, delivery, analytics, or other technical services and tools.
Use of such services may also be subject to the terms and policies of the respective providers.
15. SHOPIFY
MY CASA CONCEPT SRL uses Shopify for the technical infrastructure of the store.
The sales contract is concluded between the customer and MY CASA CONCEPT SRL.
Shopify is not the seller of MY CASA CONCEPT products.
16. PERSONAL DATA
Personal data is processed in accordance with our Privacy Policy and applicable data protection law.
17. LIMITATION OF LIABILITY
The liability of MY CASA CONCEPT SRL is determined in accordance with applicable law.
Nothing in these Terms and Conditions excludes or limits:
- mandatory consumer rights;
- the statutory guarantee of conformity;
- liability for fraud or intentional misconduct;
- any other liability that cannot legally be excluded or limited.
18. FORCE MAJEURE
We will not be liable for delays or failure to perform caused by force majeure events or circumstances beyond our reasonable control, to the extent permitted by law.
Mandatory consumer rights remain unaffected.

20. ALTERNATIVE DISPUTE RESOLUTION
Consumers may use the Alternative Dispute Resolution (ADR) mechanisms made available by the Romanian National Authority for Consumer Protection (ANPC), where the applicable legal conditions are met.
The right to bring a claim before the competent courts is not affected.
21. APPLICABLE LAW
These Terms and Conditions are governed by Romanian law and applicable European Union law.
For consumers, this provision does not limit any mandatory protection granted by applicable law.
22. CHANGES TO THESE TERMS
We may update these Terms and Conditions when necessary.
The updated version will be published in the store.
Any changes will not retroactively affect rights already acquired by the customer in relation to orders concluded before the changes took effect.
